These Terms of Service ("Terms") govern your use of the Ours mobile application ("the App") operated by Aphelion Health (Pty) Ltd ("Aphelion Health," "we," "us," or "our"), a company registered in the Republic of South Africa.

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

Ours is a mobile application for couples that facilitates a daily shared ritual to support emotional connection. Key features include:

Ours is not therapy, medical advice, or a substitute for professional help. The App is a relationship wellness tool designed to support daily emotional connection between partners. It does not diagnose, treat, or claim to resolve relationship issues. If you or your partner are experiencing distress, please seek qualified professional support.

Despite the "Health" in our company name (Aphelion Health), Ours is not a healthcare service. The name reflects our focus on emotional wellbeing, not the provision of medical care. Ours is not subject to HIPAA or equivalent healthcare-specific legislation.

4. Subscriptions and Billing

4.1 Subscription Plans

Ours offers a free tier with full core functionality and optional premium subscriptions (weekly, monthly, or annual) that unlock additional features. One subscription covers both partners in a couple.

4.2 Billing

Subscriptions are purchased and billed through the Apple App Store (iOS) or Google Play Store (Android). All billing, payment processing, and receipts are managed by Apple or Google, subject to their respective terms of service. We do not directly process or store your payment information.

4.3 Free Trials

If a free trial is offered, it will be clearly described at the time of subscription. Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan at the displayed price.

4.4 Auto-Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period unless you cancel. To cancel:

Cancellation takes effect at the end of the current billing period. You retain access to premium features until then.

4.5 Refunds

Refund requests are handled by Apple or Google in accordance with their refund policies. Aphelion Health does not process refunds directly. Please contact Apple Support or Google Play Support for refund enquiries.

5. User Content

5.1 Ownership

You retain all ownership rights to the content you create and share through Ours, including text responses, photos, voice notes, and custom prompts ("User Content").

5.2 Licence Grant

By submitting User Content, you grant Aphelion Health a limited, non-exclusive, royalty-free licence to store, process, display (to your connected partner), and back up your User Content solely for the purpose of providing and improving the App. This licence terminates when you delete your content or account, subject to the retention periods described in our Privacy Policy.

If you believe content on Ours infringes your copyright, please contact us at support@aphelion.health with: (a) a description of the copyrighted work, (b) identification of the infringing material, (c) your contact information, and (d) a statement of good-faith belief and accuracy under penalty of perjury.

6. Intimate Content

Ours includes prompts about intimacy, vulnerability, and personal feelings. You may choose to share intimate or sensitive photos, voice notes, and text with your partner through the App.

If you believe your intimate content has been misused through or in connection with the App, please contact us immediately at support@aphelion.health. We will investigate reports promptly and take appropriate action, which may include account termination and cooperation with law enforcement.

7. Couple Data and Shared Content

7.1 While Coupled

When two accounts are linked as a couple, both partners can view each other's responses once both have submitted an answer (dual-unlock). Reactions, streaks, milestones, and tap signals are shared between partners.

7.2 Account Deletion

When you delete your account, the deletion is immediate and permanent. There is no grace period or cooling-off window.

7.3 Leaving a Couple

If you leave a couple without deleting your account, the same immediate surgical removal of your shared content applies. Your partner retains their own content and will see appropriate messaging where your content was removed. Your user account remains active and you can pair with a new partner.

7.4 Acknowledgment

You understand that shared moments are visible to both partners while coupled. Once a moment is unlocked, your partner may have already viewed your response. Deletion removes content from our systems but cannot undo what your partner may have already seen.

The App, its design, features, code, prompt text, branding, and all associated intellectual property are owned by Aphelion Health (Pty) Ltd or its licensors. Your use of the App does not grant you any rights to our intellectual property beyond the limited right to use the App as described in these Terms.

Prompt text is authored by Aphelion Health and is protected by copyright. You may not reproduce, distribute, or create derivative works from prompt content outside the App.

These services are governed by their own terms and privacy policies. Aphelion Health is not responsible for the content, practices, or availability of third-party services. Your use of third-party services is at your own risk.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable law, including the Consumer Protection Act 68 of 2008 (South Africa) where applicable.

You agree to indemnify and hold harmless Aphelion Health, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

We implement industry-standard security measures to protect your data, including encryption in transit (TLS), encryption at rest (Google Cloud Platform), access control rules, and on-device voice transcription. For full details, see Section 11 of our Privacy Policy.

Despite these measures, no system is 100% secure. You acknowledge this inherent risk when using the App, particularly when sharing intimate content.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict-of-law principles.

Any dispute arising from or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

For international users: Your statutory rights under the laws of your jurisdiction (including GDPR, UK GDPR, CCPA, LGPD, and other consumer protection laws) are not affected by this choice of governing law. Where local law requires, mandatory consumer protections of your country of residence will apply.

16. Service Discontinuation

If Aphelion Health decides to discontinue Ours:

In the event of an acquisition or merger, the successor entity will be bound by the existing Privacy Policy. If material changes to data handling are planned, you will be notified and given the option to delete your account before the transfer.

17. Termination

You may delete your account at any time through the App's Settings. Deletion is immediate, permanent, and follows the surgical removal process described in Section 7.2.

We may update these Terms from time to time. When we make material changes:

Continued use of the App after the 30-day period constitutes acceptance of the updated Terms. If you do not agree, you may delete your account before the changes take effect.

Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet or telecommunications failures, or third-party service outages.
